This document (together with all documents referred to herein) establishes the conditions governing the use of this website (www.kun-kay.com) and the purchase of products on it (hereinafter, the "Conditions"), regardless of the application, digital medium, support or device through which it can be accessed. Please read these Terms and Conditions and our Privacy and Cookies Policy carefully. If you do not agree with all of the Terms and Conditions and the Privacy and Cookies Policy, you should not use this website.

1. Preliminary information on the contractual process
This websitewww.kun-kay.com is the property of KAYKUN CARE, SL with CIF B-13643762, incorporated for an indefinite period on April 13, 2023 by public deed authorized by Notary Mr. Francisco Javier Pajares Sánchez, Notary of the Illustrious College of Catalonia, registered in the Mercantile Registry of Tarragona in Volume 3372, Folio 29, Sheet T-60382.
The General Contracting Conditions regulate the distance selling relationship between KAYKUN CARE, SL and the user or client, in accordance with the legal stipulations, in Special, Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, amending the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
KAYKUN CARE, SL reserves the right to make any changes it deems appropriate, without prior notice, to the General Conditions. These modifications may be made through its pages by any legally admissible means and will be binding for as long as they are published on the website and until they are validly modified by subsequent modifications. However, KAYKUN CARE, SL reserves the right to apply, in certain cases, Specific Terms and Conditions of Contract overriding these General Terms and Conditions when it deems appropriate, announcing them in a timely manner.
The purpose of the website is to advertise, offer, and sell all types of products for pets.
The term of the contract will be linked to the delivery of the product, without prejudice to the right of withdrawal.
As a user or customer, you expressly declare that you know, understand, and accept the terms of use and these general terms and conditions of contract. Likewise, you declare that you are of legal age and have the legal capacity and authority to access the KAYKUN CARE, SL websites and enter into contracts through them.
2. Use of our website
By using this website and placing orders through it, you agree to:
- Only use this website to make legally valid inquiries or orders.
- Not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, we will be authorized to cancel it and inform the relevant authorities.
- Provide us with your email address, postal address, and/or other contact information in a truthful and accurate manner. You also agree that we may use this information to contact you if necessary (see our Privacy Policy).
If you do not provide us with all the information we require, we will not be able to process your order.
By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.

In the case of a product on sale, the offer price and validity of the offer will always be indicated along with its essential characteristics.
In compliance with current regulations, KAYKUN CARE, SL offers information on all products for sale, their characteristics, and prices. However, KAYKUN CARE, SL reserves the right to withdraw, replace, or change the products offered through its website by simply changing the content of the website. Thus, the products offered at any given time on the website will be governed by the General Terms and Conditions in force in each case. 4. Essential characteristics of the products
We pay great attention to the information regarding the characteristics of the products through technical descriptions, lists of ingredients, instructions for use, and photographs illustrating the products. All of this is done within the limits of technology and respecting the highest market standards.

5. How to place an order
To place an order, you must follow the online purchasing procedure and click "Authorize Payment." You will then receive an email confirming that your order has been successfully processed (the "Order Receipt"). A subsequent email will confirm your order, at which point your payment will be processed (the "Order Confirmation"). We will also inform you by email that the product is being shipped (the "Shipping Confirmation").
6. Technical means to correct errors
If you detect that an error has occurred when entering your personal data during your registration as a user of this website, you can modify it in the "My Account" section.
In any case, you can correct errors related to the personal data provided during the purchase process by contacting customer service by phone 621240805 or by email hello@kun-kay.com, as well as exercise the right of rectification contemplated in our Privacy and Cookies Policy through the same email.
This website displays confirmation windows in various sections of the purchase process that do not allow you to continue with the order if the data in these sections does not have been correctly provided. This website also provides details of all the items you added to your shopping cart during the purchase process, so you can modify your order details before making the payment.
If you detect an error in your order after completing the payment process, you must immediately contact our customer service team at the aforementioned telephone number or email address to correct the error, and always before sending you the order confirmation email (the "Order Confirmation"). Once the order confirmation email has been sent, no changes can be made.
7. Prices
The products will be sold at the indicated price, the price stated at the time of the customer's order confirmation being the current price. All products are listed in Euros and include Value Added Tax (VAT), but exclude shipping costs, which vary depending on the number of products purchased and the delivery area. Shipping costs will be added to the total amount due if the minimum purchase amount specified on the website has not been exceeded.
In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax, delivery of items will be deemed to be located in the territory applicable to Spanish VAT if the delivery address is located in Spanish territory, excluding the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the legally applicable rate at any given time, depending on the specific item in question.
You You expressly authorize us to issue the invoice electronically, although you may indicate at any time that you wish to receive a paper invoice, in which case, we will issue and send the invoice in that format.
Prices may change at any time, but (except as set out above) any changes will not affect orders for which we have already sent you an Order Confirmation.

9. Payment methods and order fulfillment
Once you have selected all the items you wish to purchase, they will have been added to your basket. The next step is to process the order and make the payment. To do this, you must follow the steps in the purchase process, filling in or checking the information requested at each step. You can also modify your order details during the purchase process before making the payment. Additionally, if you are a registered user, you can view details of all your orders in the My Account section.
Customers can pay for their order using any of the following methods. During the checkout process, they must indicate their choice:

- All transactions involving the transmission of personal or banking information are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information you transmit to us travels encrypted over the network.

- When paying by VISA, VISA Electron, or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed or in italics on the back of your VISA, VISA Electron, or MASTERCARD, thus offering further guarantees regarding the security of the transaction. This payment method is valid only online.
- When the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand immediate cancellation of the charge. In such cases, the corresponding debit and credit entries in the supplier's and cardholder's accounts will be made as soon as possible.

By clicking “Authorize Payment,” you are confirming that the credit card is yours.
To minimize the risk of unauthorized access, your credit card details will be encrypted. Credit cards are subject to verification and authorization by the card issuer, but if the card issuer does not authorize payment, we will not be liable for any delay or non-delivery and we will not be able to enter into any contract with you.
10. Product Availability
The availability of products offered by KAYKUN CARE, SL may vary depending on customer demand. Although KAYKUN CARE, SL updates its stock periodically, the product requested by the customer may be out of stock at that time. In the event of non-fulfillment due to unavailability, KAYKUN CARE, SL will notify the customer by email as soon as it becomes aware of this situation. This communication period will not exceed a maximum of 30 days under any circumstances. KAYKUN CARE, SL may offer the customer the option of either supplying the customer with a product of similar characteristics or higher quality at no additional cost, or, unless justified and demonstrable reasons are provided by KAYKUN CARE, SL, within this same period, refunding the amounts paid for the cancelled order.
Order Delivery
We understand that as a customer, you expect to receive your order as soon as possible. Therefore, we work to deliver your order as quickly as possible, with deliveries within 24/48 business hours on the Spanish mainland. However, launch periods, promotions, campaigns, or holidays are excluded, during which these delivery times are not guaranteed.
If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option of continuing with the purchase by setting a new delivery date or canceling the order with a full refund of the price paid. Please note, however, that we do not deliver on Saturdays or Sundays.
To find out when your order will be shipped, please keep an eye on your email inbox. We will send you a shipping confirmation for your order, and you will also receive an SMS from the logistics company indicating the estimated delivery date. If you place your order on a weekday before 11:00 a.m., you could receive it the next business day; otherwise, the delivery time will be extended by one more day. On weekends or holidays, shipments are processed the next business day.
KAYKUN CARE, SL assumes no liability when delivery of the Product is not made as a result of the information provided by the User being false, inaccurate, or incomplete, or when delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the User.
For the purposes of these Conditions, "delivery" or the order will be deemed to have been "delivered" when you acquire physical possession of the products, which will be confirmed by signing for receipt of the order at the agreed delivery address.
10.1 How does shipping work and what should I do if I am not at home on the day of delivery?
An initial delivery will be made to the indicated shipping address. If at the time of delivery you If you are not present, the branch that delivers to your area will attempt to contact you to arrange a second delivery. If you are also not present during the second delivery, the order will remain at the branch in your area so you can pick it up at the agency. If for any reason they are unable to contact you to arrange delivery, you can write to us at hello@kun-kay.com so we can provide you with the contact information or help with anything else necessary.
If 14 days have passed since your order was available for delivery and it has not been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the contract and will consider it terminated. As a result of terminating the contract, we will refund all payments received from you, excluding delivery costs, without undue delay and, in any case, within a maximum of 14 days from the date we consider the contract terminated. Please note that shipping costs resulting from termination may incur additional costs, and we are authorized to pass on the corresponding costs to you.
10.2 Can I pick up my order at a Kunkay Vet Network branch or collection point?
Yes! You can select this type of shipping ("Collection Point"), and we recommend it, as it saves you shipping costs and gives you the flexibility to pick it up at a time that best suits you within the indicated time slot of each respective veterinary center.
To this end, once the order has been prepared, we will contact you to inform you that it is available for collection. If you have opted for this delivery method, you or another person may collect the order in person by presenting the order number. Collection must take place within a maximum of 7 days. In any case, delivery of the product will be deemed to have been made 7 days after the product is available for collection at the chosen collection point, for all purposes and for the purposes of calculating the period for exercising the right of withdrawal.
If you make a purchase through the "Collection Point" delivery service, these terms and conditions will also apply to you, without prejudice to any other regulations that may apply.
10.3 How can I track my shipment?
You can track your shipment using the link found in the email confirming the shipment of your order. If you prefer, you can track your order using a tool found in the SMS sent to you by the logistics company.
10.4 Can I receive my order during the time slot of my choice?
You can leave your delivery time preferences in the carrier's comments box before completing your order. While we know they do their best to deliver within the specified time, they may experience difficulties depending on the carrier's route. Don't fret! Alternatively, if you prefer, you can select a pickup point and pick up your order whenever you prefer.
10.5 What happens if my delivery address is incorrect?
We recommend that you check the address provided when placing your orders to ensure that the information is correct and complete, as it is not possible to change the address once the shipment has been made without incurring additional shipping costs. If you notice any incorrect information, please contact us as soon as possible at hello@kun-kay.com. This may also increase the delivery delay by 24 to 48 hours. Don't forget to double-check all fields!
10.6 Holidays
Non-working days at our logistics center for 2020. Orders are not prepared on these days, so orders are delayed until the next business day. We apologize for the inconvenience:

11. Pre-Order Items
If you purchase pre-order items, they will be delivered to the address you selected within the timeframes indicated on our website.
Please note that some of these items are subject to longer delivery times, which will be those shown on the website and, in any case, will be delivered within a maximum of 30 days from the date of the Order Confirmation.
In the case of mixed orders consisting of products corresponding to the regular purchasing process and pre-order products ("Mixed Orders"), the items will have been ordered by you in the same order, but they may be delivered separately and in different timeframes.
Once the pre-order products have been prepared, we will contact you to inform you that they are being shipped ("Shipping Confirmation").
If you purchase a product on Pre-sale, all provisions contained in these Conditions will also apply to you.
12. Transfer of Risk and Ownership
The risks of the products will be your responsibility from the moment of delivery.
You will acquire ownership of the products at the time of delivery (as defined in clause 11 above).
13. Guarantees
The reported functionality of the product is based on scientific studies related to its composition of each active ingredient. However, KAYKUN CARE, SL does not guarantee the effectiveness and results of the products in each particular case. Occasionally, the products may require additional treatments to resolve the problem.
Follow the product administration instructions on the label exactly. KAYKUN CARE, SL is in no way responsible for the effectiveness of the product or its side effects when the product is used for purposes other than those indicated, is supplied at a different or higher dose than indicated, or if the product is administered after the best-before date has passed.

14. Right of withdrawal, returns, and complaints
14.1 Right of withdrawal
If you are contracting as a consumer and user, you have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days after the day you acquired physical possession of the goods or, if the goods comprising your order are delivered separately, 14 calendar days after the day you acquired physical possession of the last of those goods (with the specific details regarding product delivery provided for in point 10.2).
To exercise your right of withdrawal, you must notify us by email at hello@kun-kay.com, your decision to withdraw from this contract by means of an unequivocal declaration (for example, a letter) or by means of the model withdrawal form that you may request from us, although this is not mandatory. To comply with the withdrawal period, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.
14.2 Consequences of withdrawal
In the event of withdrawal on your part, we will refund all payments received from you, excluding delivery and return costs, without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will process the refund using the same payment method you used for the initial transaction, unless you inform us otherwise, expressly detailing the payment method through which you wish us to process the refund. You will not incur any costs as a result of the refund. Notwithstanding the foregoing, we may withhold the refund until we have received the goods back, or until you have provided proof of their return, whichever is met first.
You must return or deliver the products to us directly via courier without undue delay and, in any event, within a maximum period of 14 calendar days from the date you notify us of your decision to withdraw from the contract. The deadline will be deemed met if you return the goods before this deadline has expired. You must bear the direct cost of returning the products. Please note that if you choose to return the items to us carriage forward, we will be entitled to charge you for any costs we may incur.
You will only be liable for any diminished value of the goods resulting from the handling other than that necessary to establish the nature, characteristics, and functioning of the goods.
14.3 Common Provisions
You will not have the right to withdraw from the contract for the supply of any of the following products:
- Personalized items.
- Goods sealed for health or hygiene reasons that have been unsealed after delivery.
Your right to withdraw from the contract applies only to products returned in the same condition as you received them. No refund will be issued if the product has been used, or if the product is not in the same condition as when it was delivered, or if it has suffered any damage. Therefore, you must take care of the product(s) while they are in your possession. Please return the item using or including all its original packaging, instructions, and any other accompanying documents.
After examining the item, we will inform you if you are entitled to a refund of the amounts paid. The refund will be issued as soon as possible and, in any case, within 14 days from the date you notified us of your intention to withdraw. However, we may withhold the refund until we have received the goods. The refund will always be issued using the same payment method you used to pay for the purchase. Please note that, once your order has been delivered, if you exercise your legal or contractual right of withdrawal, we cannot assume the risk of returning the package if it is due to reasons not attributable to KAYKUN CARE, SL.
Likewise, remember that you will be responsible for the contents of the return package. In the event that there is an error in the contents of the return package not attributable to KAYKUN CARE, SL, we will be authorized to charge you the corresponding costs if we are able to arrange for the package to be returned to you.
In any case, the rights and remedies recognized by current legislation are subject to change.
14.4 Returns of Defective Products
In cases where you consider that at the time of delivery the product does not conform to the provisions of the contract, you must contact us immediately through our contact channels, providing the product details as well as the damage or defect it suffers, or by calling 621240805, where we will inform you how to proceed.
You can hand the product over to a courier that we will send to your address when you request collection.
We will carefully examine the returned product and We will inform you by email within a reasonable timeframe whether a refund or replacement is appropriate (if applicable). The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days of the date on which we send you an email confirming that the refund or replacement of the non-conforming item is appropriate.
Amounts paid for products returned due to a defect, if one actually exists, will be fully refunded, including the delivery costs incurred to deliver the item to you and the costs you incurred to return it to us. The refund will be made using the same payment method used to pay for the purchase.
In any case, the rights recognized by current legislation are preserved.
15. Liability and Disclaimer
Except as expressly provided otherwise in these Terms, our liability in connection with any product purchased through our website will be strictly limited to the purchase price of that product.
However, and unless otherwise provided by law, we will not accept any liability for the following losses, regardless of their origin:
- loss of income or sales;
- loss of business;
- loss of profits or loss of contracts;
- loss of anticipated savings;
- loss of data; and
- loss of administrative or office time.
Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of any information transmitted or obtained through this website unless expressly stated otherwise.

17. Viruses, Hacking, and Other Computer Attacks
You must not misuse this website by knowingly introducing viruses, Trojan horses, worms, logic bombs, or any other technologically harmful or damaging programs or material. You must not attempt to gain unauthorized access to this website, the server on which this website is stored, or any server, computer, or database linked to our website. 20. Notices
Notices from you to us must be sent to our email address hello@kun-kay.com. Subject to Clause 20 above and unless otherwise stated, we may send you notices to the email or postal address you provide when placing an order.
Notices will be deemed to have been received and properly given when posted on our website, 24 hours after an email is sent, or three days after the posting of any letter. To prove that service has been effected, it will be sufficient to prove, in the case of a letter, that it had the correct address, was properly stamped, and was duly delivered to the post office or mailbox, and, in the case of an email, that it was sent to the email address specified by the recipient.
21. Events Outside Our Control
We will not be liable for any failure to perform, or delay in performance of, any of our obligations under this Agreement that results from events outside our reasonable control ("Force Majeure Events").
Force Majeure Events include any act, event, failure to perform, omission, or accident beyond our reasonable control, including, but not limited to, the following:
- Strikes, lockouts, or other industrial action.
- Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster.
- Impossibility of using trains, ships, aircraft, motor transport, or other means of transport, whether public or private. private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
Obligations will be deemed to be suspended for the duration of the Force Majeure Event, and we will have an extension of the time to perform such obligations for a period equal to the duration of the Force Majeure Event. You and we acknowledge that we have agreed to enter into a contract without relying on any representation or promise made by the other party or that could be inferred from any statement or writing in the negotiations between us before the contract, except as expressly mentioned in these Terms and Conditions.
Neither you nor we will have any remedy in respect of any untrue statement made by either party, whether oral or in writing, prior to the date of a contract (unless such untrue statement was made fraudulently), and the other party's only remedy will be for breach of contract in accordance with these Terms and Conditions.
23. Our right to vary these terms and conditions
We reserve the right to vary the Terms and Conditions. The modifications introduced will not be retroactive.
If you do not agree with the modifications introduced, we recommend that you do not use our website.
24. Jurisdiction
Furthermore, KAYKUN CARE, SL reserves the right to file any civil or criminal actions it deems appropriate for improper use of its website and content or for non-compliance with these conditions.
The relationship between the user and the provider will be governed by the regulations in force and applicable in Spain. Any dispute arising from or related to the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts.
If you are contracting as a consumer, nothing in this clause affects your rights under current legislation.
