Legal Terms of the Collaborative KUNKAY & HOCIQO BRAND Giveaway

1.- PROMOTING COMPANY

The companies responsible for this promotion are:

KUNKAY (KAYKUN CARE SL), located at Carrer ROMANÍ, 20, 6th floor, Door 3 C.P. 43204, Reus, CIF B-13643762, email: hello@kun-kay.com

HOCIQO BRAND, located at C/Alt de la barsella 2, Banyeres de Mariola (Alicante) 03450 NIF 21693956B, email: guau@hociqo.com

Hereinafter, “the Companies”.

2.- PURPOSE AND SCOPE OF THE PROMOTION

The Companies organize this giveaway with the objective to:

  • Promote and spread the brands of the organizing companies.
  • Increase the visibility of their social media profiles.
  • Encourage interaction with their followers, contributing to the legitimate and transparent growth of the community of followers of both brands.
  • Territorial scope: Spain (only Peninsula and Balearic Islands) and Portugal (only peninsula)
  • Participation: free and without purchase obligation.

3.- PROMOTION DATES

Start: October 5 at 19:30 h

End: October 13 at 23:59 h

The Companies reserve the right to modify the promotion dates, provided participants’ rights are not affected and prior notice is given.

4.- PARTICIPATION REQUIREMENTS

Participants may be:

  • Persons over 18 years old, residents in Spain (only Peninsula and Balearic Islands) and Portugal (only peninsula)
  • Comply with all conditions established in these legal terms.

Exclusions:

  • Employees of the Companies, agencies linked to the promotion, and direct family members.
  • Participation with false or third-party data will not be valid.

5.- PARTICIPATION MECHANICS

To participate, participants must:

  1. Follow the Instagram profiles: @hociqobrand and @kunkaycare.
  2. Like the giveaway post.
  3. Tag 2 friends in the post.
  4. Share the post in stories to get more chances to participate.

Participation is free.

6.- PRIZES AND ECONOMIC VALUE

The prizes consist of:

  • A dog bed provided by HOCIQO, valued at €255.
  • A €250 voucher to choose products from KUNKAY.

Conditions:

  • Prizes are personal and non-transferable, not redeemable for cash.
  • Each company is only responsible for delivering its own product.
  • In case of prize unavailability, it may be replaced by another of equal or greater value, notifying the winner of the substitution.

7.- WINNER SELECTION AND ANNOUNCEMENT

  • Selection will be made randomly through a certified platform for giveaways and games.
  • The winner will be announced on October 14 via Instagram.
  • If the winner cannot be located within 48 hours, an alternate winner will be selected following the same procedure.

8.- PRIZE DELIVERY

  • The winner must provide the necessary data for delivery: full name, ID, postal address, email, and phone number.
  • The Companies are not responsible for delays, losses, or damages during shipping attributable to third parties.

9.- PERSONAL DATA PROTECTION

Data controllers: KUNKAY (KAYKUN CARE SL) and HOCIQO BRAND.

  • Purpose: manage participation and prize delivery.
  • Legal basis: consent of the data subject.
  • Data will be kept as long as necessary for managing the giveaway.
  • Participants may exercise their ARCO / GDPR rights via the emails: hello@kun-kay.com and guau@hociqo.com
  • Winners’ names/aliases may be published to ensure transparency, requesting their consent when necessary.

10.- IMAGE RIGHTS

Winners authorize the Companies to use their name and, if applicable, their photograph for promoting the giveaway and commercial dissemination, without additional compensation.

11.- LIABILITY AND FORCE MAJEURE

  • The Companies are not responsible for technical failures, third-party actions, external platform functioning (Instagram, web, etc.), or incidents beyond their control.
  • They reserve the right to cancel, modify, or suspend the promotion in case of fraud, technical errors, or force majeure, without participants being able to claim compensation.

12.- ACCEPTANCE OF TERMS

Participation implies full and unconditional acceptance of these terms.

13.- APPLICABLE LAW AND JURISDICTION

The promotion is governed by current Spanish law.

Any conflict will be resolved before the Courts and Tribunals corresponding to the participant’s domicile.
